ARCON’s regulation of advert contents on digital and social media spectrum
The recent affirmation by the Federal High Court in Lagos that Advertising Regulatory Council of Nigeria, ARCON, has the power to regulate advertising contents across every platform, both traditional media and social media is highly commendable.
That ARCON recognizes the urgent need to bring structure and accountability to this booming space by introducing clear guidelines to regulate advertising content across digital and social media platforms, especially in today’s fast-evolving digital landscape is also a welcome development.
This move is not just appropriate — it is timely and critical.
Over the year, Nigeria’s digital advertising space has operated with little oversight. Brands, influencers, and content creators have produced misleading claims, and unethical practices that risk harming consumers and tarnishing the credibility of the advertising industry.
Interestingly, ARCON’s extending its regulatory oversight to social media and the entire digital spectrum signals that advertising must be responsible, truthful, and respectful of the public interest, regardless of the medium, and the people placing it.
The era of unguarded advert messages is gone with ARCON’s jurisdiction extended to regulating advertising on digital and social media. Every advertising material, online or offline must meet the same professional standards, promoting fair competition and encouraging better-quality content across the board.
Though there are challenges ahead, considering that the digital space is vast, fast-paced, and sometimes anonymous, ARCON must invest heavily in digital monitoring, collaboration with platforms like Meta (Facebook, Instagram), TikTok, X (formerly Twitter), and even train its teams to spot and act swiftly to address violations.
Additionally, education and stakeholder engagement will be crucial to securing widespread adoption of the rules and regulations guiding the new regulation. This will enable content creators, especially smaller influencers to key into formal compliance and disabuse their mind from perceived cost or complexity.
As ARCON moves decisively to regulate advertising on social media,
this will send a strong message that while creativity and innovation are encouraged, they must exist within a framework of honesty, professionalism, and respect for consumer rights.
In the end, regulated digital advertising will benefit everyone — consumers will be better protected, brands will operate on a fairer playing field, and the Nigerian advertising industry will grow stronger and more reputable on the global stage.
However, at BrandImpact Nigeria, we strongly believe that ARCON should prioritize regulation over strangulation, as its Director General, Dr. Olalekan Fadolapo, often emphasizes. We also believe that businesses can only thrive and fulfill the true purpose of regulation when there is an enabling environment, a commitment to equity, and a shared sense of purpose.
